Hennepin County Homeowners Face Growing Code Compliance Pressure as Building Regulations Drive Chimney Reconstruction Needs

As 2025 unfolds, homeowners across Hennepin County are discovering that aging chimneys are increasingly falling short of current building code standards, creating a significant challenge for property owners who thought their heating systems were functioning adequately. Hennepin County Code Enforcement Offices ensure compliance with building codes, zoning rules, and other regulations, typically working at the Hennepin County or local level in Minnesota. The Code Enforcement Office enforces building codes and keeps records on all codes and regulations, as well as making reports about Hennepin County building code violations.

Understanding the Current Code Compliance Landscape

The enforcement of building codes has become more stringent as Code Enforcement Offices in Hennepin County, Minnesota ensure compliance with building codes, zoning rules, and other regulations. As part of their responsibility over codes and regulations, Code Enforcement Offices issue Hennepin County building permits. This increased scrutiny means that chimneys constructed decades ago under older standards may no longer meet current safety requirements.

The 2020 Minnesota State Building Code is effective March 31, 2020, except for the Minnesota Mechanical Fuel Gas Code, which is effective April 6, 2020. These updated codes include specific requirements for chimney construction and safety that often necessitate complete reconstruction rather than simple repairs.

Key Building Code Requirements Driving Reconstruction

Modern chimney regulations are comprehensive and demanding. Chimneys shall extend not less than 2 feet (610 mm) higher than any portion of a building within 10 feet (3048 mm), but shall be not less than 3 feet (914 mm) above the highest point where the chimney passes through the roof. Masonry chimneys shall have a concrete, metal or stone cap, a drip edge and a caulked bond break around any flue liners in accordance with ASTM C1283.

Additionally, Any portion of a masonry chimney located in the interior of the building or within the exterior wall of the building shall have a minimum airspace clearance to combustibles of 2 inches (51 mm). Chimneys located entirely outside the exterior walls of the building, including chimneys that pass through the soffit or cornice, shall have a minimum airspace clearance of 1 inch (25 mm). These clearance requirements often cannot be met by older chimneys without complete reconstruction.

The Financial Reality of Code Compliance

When code enforcement identifies violations, homeowners face significant decisions. These permits may be required for land development, demolition, renovations, repairs, and other types of construction. The Code Enforcement Office may also issue Hennepin County occupancy permits at the end of a construction project to certify that the building meets code and can be occupied. The cost of bringing an older chimney into compliance often exceeds the expense of complete reconstruction, making rebuild the most economical choice.

Why Professional Assessment Is Critical

Many homeowners are surprised to learn their chimneys need complete reconstruction. Professional inspection reveals issues that aren’t immediately apparent, including inadequate footings, improper clearances, and outdated materials that don’t meet current safety standards. Footings for masonry fireplaces and their chimneys shall be constructed of concrete or solid masonry not less than 12 inches (305 mm) thick and shall extend not less than 6 inches (152 mm) beyond the face of the fireplace or foundation wall on all sides. Footings shall be founded on natural, undisturbed earth or engineered fill below frost depth.
